Protection of Personal Information Act — how we handle your data.
David Spearman Letting (Pty) Ltd ("we", "us", "our") is committed to protecting the personal information of our clients, tenants, landlords, and website visitors in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA").
We may collect the following types of personal information: full name and identity number; contact details including phone number and email address; residential and postal address; employment and income information; banking details for disbursements; credit and reference check data through TPN.
We collect personal information to: process rental applications and assess suitability of tenants; manage lease agreements and rental accounts; maintain communication between landlords and tenants; comply with legal obligations; improve our services.
All personal information is stored securely. We implement appropriate technical and organisational measures to prevent unauthorised access, disclosure, alteration, or destruction of your personal information. Access is restricted to authorised staff only.
We will not sell or share your personal information with third parties without your consent, except where required by law or where necessary to provide our services (e.g., sharing with TPN for credit screening, or with our attorneys NSG Attorneys where legal action is required).
Under POPIA, you have the right to: access the personal information we hold about you; request correction of inaccurate information; object to the processing of your information; request deletion of your information (subject to legal retention requirements); lodge a complaint with the Information Regulator.
We retain personal information for as long as required by law or as necessary for the purposes for which it was collected. Rental and financial records are retained for a minimum of 5 years.
